AB 130 Funding

Source of Funds

This is one-time funding apportioned to special education local plan areas (SELPAs) based on pupils with exceptional needs as reported in Fall 1 Census for the 2019-20 and 2020-21 fiscal years.

The purpose of the Dispute Prevention and Dispute Resolution (aka ADR) funds is to support local educational agencies in conducting dispute prevention and voluntary alternative dispute resolution activities to prevent and resolve special education disputes resulting from school disruptions stemming from the COVID-19 public health emergency during the period of March 13, 2020, to September 1, 2021, inclusive. The apportionment letter and the schedule of apportionment can be accessed on the CDE’s web page here.

The purpose of the Learning Recovery funds is to provide learning recovery support to pupils, as defined in Assembly Bill 130, Section 161, associated with impacts to learning due to school disruptions stemming from the COVID-19 public health emergency during the period of March 13, 2020, to September 1, 2021, inclusive. The apportionment letter and the schedule of apportionment can be accessed on the CDE’s web page here.

Funding Allocation

SELPAs allocated 80 percent of the ADR amount received proportionally to Member LEAs using the greater of the member's Fall 1 Census special education date for the 2019-20 or 2020-21 fiscal years, by District of Residence:

Accounting

Revenue for ADR was transferred using 0100-65360-0-5001-0000-859000. 
Expenditures for ADR can be coded to 0100-65360-0-5xxx-xxxx-xxxxxx.

Revenue for Learning Recovery was transferred using 0100-65370-0-5001-0000-859000. 
Expenditures for Learning Recovery can be coded to 0100-65370-0-5xxx-xxxx-xxxxxx.

LEAs may apply their allowable indirect cost rate. 

Use of Funds

These funds are used to support Member LEAs in conducting dispute prevention and voluntary alternative dispute resolution activities to prevent and resolve special education disputes resulting from school disruptions stemming from the COVID-19 public health emergency during the period of March 13, 2020, to September 1, 2021, inclusive, in a collaborative and equitable manner. Financial Reporting

Funds should be legally obligated by June 30, 2023. Complete the AB 130 Expenditure Reports at the prescribed timelines.
